Mithaq operates as a digital facilitation platform. The following defines the precise scope of our services and the limitations of our legal responsibility.
Mithaq provides digital tools to facilitate the creation, documentation, and management of marriage agreements. Mithaq does not provide legal advice, legal representation, or any form of legal services regulated by applicable bar associations or legal professional bodies in any jurisdiction.
Mithaq does not act as, represent, or substitute for any governmental authority, notarial body, religious institution, or judicial entity. Documents generated through the platform do not constitute official governmental records unless separately registered with the competent authority in the user's jurisdiction.
Users bear sole responsibility for verifying that any agreement created through Mithaq complies with the laws of their jurisdiction. Mithaq makes no representation as to the legal enforceability of any agreement in any specific jurisdiction.
SaaSolution SL and Paradox FZCO expressly disclaim liability for any misuse of platform outputs, submission of incorrect or fraudulent data, jurisdictional invalidity of agreements, or misinterpretation of regulatory requirements. Users assume full responsibility for the accuracy of information submitted.
Personal data is processed strictly on the basis of contractual necessity and user consent, in accordance with applicable data protection law. Mithaq does not sell, monetize, or disclose personal data to third parties for commercial purposes.
Where personal data is transferred across borders, Mithaq implements appropriate transfer mechanisms including Standard Contractual Clauses, adequacy decisions, or binding corporate rules. Users in jurisdictions with specific data localization requirements should contact our compliance team prior to use.
Liability Framework
The following provisions govern the scope of liability and warranty applicable to all use of the Mithaq platform.
Services Provided "As Is"
The Mithaq platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.
No Implied Warranties
To the fullest extent permitted by applicable law, SaaSolution SL and Paradox FZCO expressly disclaim all implied warranties. No oral or written information provided by Mithaq or its representatives shall create any warranty not expressly stated in these terms.
No Consequential Damages
In no event shall Mithaq, SaaSolution SL, or Paradox FZCO be liable for any indirect, incidental, special, consequential, regulatory, cross-border, or punitive damages, including loss of profits, data, business, or goodwill.
Liability Cap
The aggregate maximum liability of Mithaq, SaaSolution SL, and Paradox FZCO for any and all claims shall not exceed the total fees paid by the user during the twelve (12) months preceding the claim.
User Enforceability Responsibility
Users assume sole responsibility for determining and ensuring the legal enforceability of agreements in their jurisdiction. Mithaq provides no assurance that any agreement will be recognized or enforced by any court or governmental body.
Regulatory Interpretation
Mithaq does not provide regulatory compliance advice. Users are solely responsible for obtaining independent legal and regulatory advice. Mithaq's compliance matrix is informational only and does not constitute legal opinion.
